The Honolulu Star-Advertiser reports that a judge will rule whether to dismiss the challenge by the end of the month.
Circuit Judge Karen Nakasone has ordered Say to prove his residency in court. But Say’s attorneys argue that only the House can determine whether lawmakers meet the requirements to serve.
Six voters in Honolulu’s Palolo neighborhood want to oust Say because they contend he doesn’t live there. Say has represented the area since 1976.
The former speaker says his residence is in Palolo, but he spends time with his family in another area.
Say’s attorneys want the judge to decide whether the House or the courts have jurisdiction.
